When your car is stolen or gets damaged in an accident, the repair or recovery cost is only part of the story. Going without your car while it’s being repaired can be a significant hardship. Without another vehicle available, your only recourse might be to rent one. The good news is that you might be able to buy insurance that will pay some of the cost of a rental; in fact, your policy might already include it.

The standard Personal Auto Policy OFFERS  a coverage called ”Rental Car Benefit”. You must agree to and buy the coverage for it to benefit you when you need it.

In speaking to a group of local business people yesterday, we asked how many people in the room were dependent on their vehicle daily. EVERY PERSON raised their hand.

If you have purchased Collision coverage on your car and that car is damaged in a collision, this coverage will pay for “temporary rental car expenses.” The same applies if you have purchased Comprehensive coverage. If the car is damaged by something other than a collision, the policy will cover these expenses. The policy pays up to the limit per day you purchase, $30, $40, $50, up to a maximum of dollar amount, normally 30 days times your daily limit. This coverage may also apply to a vehicle to which you do not ordinarily have access, such as a friend’s car or a rented pickup truck.

Time limitations apply. If your owned or borrowed car is stolen, coverage begins a specified number of hours after the theft and ends when you are able to use the vehicle again or when the insurance company pays you for the loss. If the cause of loss is something other than theft, the insurance pays the expenses incurred more than 24 hours after you lose use of the vehicle. Finally, the insurance stops paying at the end of the period of time reasonably required to repair or replace the vehicle.

Some examples will illustrate how this works.

  • >>> John has both Comprehensive and Collision coverage on his sedan. On Tuesday at 10:00 a.m., a frayed wire in the engine catches fire, resulting in major damage to the car. The car is in the shop for 15 days, so he rents a replacement for $35 per day. His insurance will pay $30 per day, starting with the expenses he incurs after 10:00 a.m. Wednesday. If 15 days is a reasonable time for these repairs, the company will pay for days two through 15.
  • >>> John gets his sedan back. A month later, it breaks down. This time, he borrows his neighbor’s car. While he is driving this car, a deer runs in front of him; the ensuing collision badly damages the car. Because he has Comprehensive coverage, which applies to collisions with animals, his insurance again will pay $30 a day for him to rent a replacement while the shop fixes his car.
  • >>> He gets both cars back and returns his neighbor’s car. A week later, he walks out of a store to find an empty space where his car should have been. He reports the theft to the police and his insurance company. The company will pay $30 per day, starting 48 hours after he discovered the car missing. It takes 35 days for him to find a replacement car; his insurance pays $900 (the maximum) for his rental costs.
  • >>> Concerned about how much his insurance premiums will go up, he drops the Collision coverage on the replacement car. A month later, a bee stings him while he’s driving and he plows into a highway sign. This time, the company will not cover his rental costs because he had not purchased Collision coverage.

Not all Auto insurance policies are the same. Some might pay more than $30 per day for rental costs, but they will pay only if the insured vehicle is stolen. Others cover theft only and pay less than $30.

The recent health care legislation signed into law by President Barack Obama contains a Small Business Health Care Tax Credit that will help small businesses with the cost of providing their employees with health care. The tax credit’s benefits are available immediately for the 2010 tax year.

According to the Congressional Budget Office, small businesses are expected to save an estimated $40 billion by 2019, due to the Small Business Health Care Tax Credit. The tax credit is effective retroactive to January 1st, 2010 and covers up to 35% of a small business’s premiums, with the rate increasing to 50% on January 1st, 2014.

Although non-profit organizations are eligible for the credit, they will receive a lower percentage. Tax exempt organizations will be able to receive up to a 25% tax credit in 2010, which will be raised to 35% in 2014.

The tax credit has broad eligibility, covering 4 million small businesses. Any business that pays at least 50% of employee health care costs, employs the equivalent of 25 or fewer fulltime workers (allowing eligibility for companies with 50 part-time workers), and pays an average employee salary of $50,000 or less (not including owners and their family members) will be eligible for the Small Business Health Care Tax Credit.

The maximum credit of 35% is available for small businesses with 10 or fewer fulltime workers and an average salary of $25,000 or less. For businesses that pay employees between an average of $25,000 and $50,000, the tax credit gradually phases out. The gradual phase out also applies to businesses that employ an equivalent of 10 to 25 full time workers (20 to 50 part time workers).

Businesses are able to claim the credit for a total of six years. They will be eligible to claim the credit for four years, from 2010 to 2013, and then any two years after the 2013 date.

To keep businesses from abusing the system by picking a high-cost plan, the Small Business Health Care Tax Credit will only be eligible for the average health insurance cost of the state where the business is located. This information will be provided by the IRS at a later date.

Here are tips from the U.S. Consumer Product Safety Commission for safeguarding your family.

Gas grill safety tips

When cooking outdoors with a gas grill, check the air tubes that lead into the burner for any blockage from insects, spiders or food grease, and follow these tips to reduce the risk of fire or explosion:

1. Check grill hoses for cracking, brittleness, holes and leaks. Make sure there are no sharp bends in the hose or tubing.

2. Move gas hoses as far away as possible from hot surfaces and dripping hot grease.

3. Always keep propane gas containers upright.

4. Never store a spare gas container under or near the grill or indoors.

5. Never store or use flammable liquids, like gasoline, near the grill.

6. Never keep a filled container in a hot car or car trunk. Heat will cause the gas pressure to increase, which may open the relief valve and allow gas to escape.

Charcoal grill safety tips

1. Charcoal produces carbon monoxide (CO) when it is burned. CO is a colorless, odorless gas that can accumulate to toxic levels in closed environments. To reduce the risk of CO poisoning:

2. Never burn charcoal inside of homes, vehicles, tents or campers.

3. Charcoal should never be used indoors, even if ventilation is provided.

4. Since charcoal produces CO fumes until the charcoal is completely extinguished, do not store the grill indoors with freshly used coals.

5. Every year there are thousands of Emergency Room visits due to grilling accidents, we hope these tips will help you avoid becoming one of them.

PS Here’s a little 4th of July history –  “Independence Day, commonly known as July 4th or the Fourth of July, commemorates the Continental Congress’ adoption of the Declaration of Independence on July 4, 1776. The document, primarily written by Thomas Jefferson, served as a formal announcement that the 13 American colonies were no longer part of the British Empire and would henceforth be free and independent states. Regarded as the birthday of the United States of America.

By the end of 2009, 45 states, the District of Columbia, and two U.S. territories had enacted laws requiring notification of security breaches involving personal information. New York’s law is typical. It requires businesses that own or license computer data that includes private information to disclose any security breach of the system to any state resident whose private information the business believes was accessed without authorization. The businesses must provide the notice by mail, phone or e-mail as soon as possible after discovering the breach, inform the state government of the notices, and inform consumer reporting agencies if the breach affected more than 5,000 residents.

Notifying the victims is only one part of the costs businesses that suffer security breaches can expect. They might face lawsuits from the victims, fines from regulators, and serious harm to their reputations. Lockton International has estimated the cost of a security breach to be $15 per person affected. Lockton issued a paper in 2010 that discussed several ways that businesses can avoid cyber attacks and handle those that do occur, including:

  • 1. Assemble a multifunctional team to identify cyber risks and develop plans for preventing attacks. The team should include individuals responsible for legal compliance, risk management or insurance, information technology, procurement of vendors, and operations.
  • 2. Comply with applicable federal and state laws and regulations, including HIPAA (which applies to security of private health information) and the Gramm-Leach-Bliley Act (which applies to private financial information.)
  • 3. Manage vendors that have a high risk of data security breaches, including payroll companies, credit card processors, and accountants. Require them to meet legal and industry standards, obtain insurance against security breaches, and indemnify the business from related losses.
  • 4. Manage the people as well as the system. Train and educate employees on system security, monitor them for poor security practices and possible malicious acts, and verify that they have not installed unauthorized software that would increase vulnerabilities in the system.
  • 5. Regularly test the system and repair security problems. Perform internal tests, external system penetration tests, scans for viruses and other malware, and evaluate work processes.
  • 6. Encrypt private data on the network, while it is being e-mailed or transferred another way, and while it is on laptops, smart phones, and other mobile devices.
  • 7. The team should develop a plan for effectively responding to security breaches.

As more businesses become aware of their exposure to data losses, insurance companies are beginning to offer specialized policies to cover these incidents. An electronic data liability policy covers a business’s liability for damages resulting from accidents, negligent acts, errors or omissions, or a series of these, leading to a loss of electronic data. Coverage applies to claims made during the policy period for losses occurring on or after a date specified in the policy. Another policy offered by specialty insurers covers a business’s lost income and extra expenses resulting from harm to its reputation after a security breach.

Most businesses and organizations today have some exposure to loss from cyber risks. Just as they try to prevent fires, car accidents, and workplace injuries, businesses must make preventing data security breaches a standard part of their operations.
